As of November 4, inert waste deriving from construction and demolition, and other inert waste of mineral origin, subject to recovery operations, are no longer classified as waste.
This was established by Ministerial Decree 152 of September 27, 2022, with which the Ministry of Ecological Transition implements a first important intervention for the circular development of the construction sector, in line with the strategic objectives set out in the European Plan of Action and the national strategy approved under the PNRR.
Ministerial Decree 152/2022, consisting of 8 articles and 3 annexes, defines:
— the waste concerned (including, for example, those corresponding to the following EER Codes 170102, 170103, 170107, 170302, 170504, 170508, 170904);
— the compliance criteria for the purpose of terminating the qualification of refusal;
— specific usability purposes (e.g. road, railway, airport substrates, environmental recovery, filling and filling, packaging of concrete and mixtures bound with hydraulic binders);
— documentary obligations

The measure - explains the Ministry - also identifies an innovative administrative path, a sort of 'coupon', the result of conversations with the Council of State, to take into account the specific applications and complexity of a sector that affects small, medium and large companies.
To this end, the dicastery's technicians, according to the addresses of Minister Gilberto Pichetto, are already working with the support of ISPRA and ISS, to acquire the necessary technical elements, from an environmental and health point of view, with the aim of evaluating any updates to the measure, before the end of the 180-day monitoring phase following the entry into force of the standard.
